TERMS AND CONDITIONS

General terms and conditions (T&C) for orders via www.sanfterjunge.com

In the following we would like to introduce you to our general terms and conditions, which we use as a basis for processing and handling your purchase. We offer you the purchase of dog supplies on https://www.sanfterjunge.com. Dog supply articles are all articles that we offer you on www.sanfterjunge.com, as long as we do not point out to you that they are partner articles. Partner articles are articles that we offer you on www.sanfterjunge.com and which we mark as partner articles.

1. CONCLUSION OF CONTRACT AND DELIVERY OF GOODS

1.1 We conclude contracts via www.sanfterjunge.com exclusively in German and English. When ordering articles, your contractual partner is Sanfter Junge, Ländlistrasse 11, 8274 Gottlieben and when ordering partner articles, the respective partner is also the one whose identity we will inform you individually on the respective product detail page.

 

1.2 By clicking the button "order for a fee" you place a binding order for the items in the shopping cart. We will confirm the receipt of your order by email immediately after sending the order. A binding contract is concluded upon receipt of the order confirmation. Please note that the delivery of the ordered goods with advance payment (reservation) takes place as soon as we have received payment of the full purchase price and any shipping costs. We therefore ask you to transfer the purchase price immediately after receipt of the order confirmation, but no later than within 7 days.

1.3 You agree to the assignment of the seller's claims for payment of the purchase price to third parties, in particular to Wix Payments and Klarna Bank AB.

1.4 Please note that, as an exception, we are not obliged to deliver the goods ordered if we have properly ordered the goods on our part but have not been delivered correctly or on time. The prerequisite is that we are not responsible for the lack of availability of the goods and that we have informed you of this fact immediately. If the goods are subsequently unavailable, we will immediately reimburse you for payments already made.

1.5 We deliver orders within Switzerland and Europe. If working days are specified as deadlines, we mean all days from Monday up to and including Friday, with the exception of public holidays.

2. PRICES, SHIPPING CHARGES AND EXPRESS SHIPPING

2.1 The prices listed in the offer at the time of the order apply. The prices quoted are final prices, i.e. they include the applicable statutory value added tax.

2.2 We will cover the shipping costs for you, except for Next Day Evening Delivery.

2.3 For the shipping of particularly bulky, heavy or valuable items, different shipping charges may apply, which we will state for each product individually on the product detail page and on the order page during the sale.

3. PAYMENT

3.1 In principle, we offer the payment methods prepayment, credit and debit card. With every order we reserve the right not to offer certain payment methods and to refer to other payment methods. Please note that we only accept payments from accounts in Switzerland and within the European Union (EU). You have to bear any costs of a money transaction.

3.2 In the case of a purchase by credit or debit card, your credit or debit card account is debited when we dispatch the order.

3.3 You agree to receive invoices, credits and reminders in electronic or paper form.

4. PROMOTIONAL VOUCHERS AND THEIR REDEMPTION

4.1 Campaign vouchers are vouchers that cannot be purchased, but that we issue as part of advertising campaigns with a certain period of validity.

4.2 Campaign vouchers can only be redeemed within the specified period and only once as part of an order process. Individual branded products can be excluded from the voucher campaign. Promotion vouchers cannot be used to purchase gift vouchers. Please note that campaign vouchers can be tied to a minimum order value.

4.3 The value of the goods must be at least equal to the amount of the campaign voucher. A difference to a higher value of goods can be compensated with the payment options offered. The value of a campaign voucher is neither paid out in cash nor is interest paid. The campaign voucher will not be refunded if the goods are wholly or partially returned.

4.4 Promotional vouchers can only be redeemed before the order process has been completed. Subsequent crediting is not possible. The campaign voucher cannot be transferred to third parties. Several campaign vouchers cannot be combined with one another unless we have agreed otherwise.

4.5 If you used a promotional voucher for your purchase, we reserve the right to charge you the original price of the goods you are keeping if - due to your cancellation - the total value of the order falls below the value of the promotional voucher.

5. GIFT CERTIFICATES AND THEIR REDEMPTION

5.1 Gift vouchers are vouchers that you can purchase. These can only be redeemed for the purchase of articles and partner articles, but not for the purchase of additional gift vouchers. If the balance of a gift voucher is insufficient for the order, the difference can be offset with the payment options offered.

5.2 Gift vouchers and credit can only be redeemed before the order process has been completed. The balance of a gift voucher is neither paid out in cash, nor is interest paid.

6. RETURN POLICY FOR ITEMS

For all purchases of articles at www.sanfterjunge.com, Sanfter Junge grants a voluntary right of return for a total of 14 days from receipt of goods. You can then withdraw from the contract by sending the goods back to us within 14 days of receipt of the goods (the period begins on the day after receipt of the goods). Timely dispatch is sufficient to meet the deadline. However, the prerequisite for exercising the right of return is that the goods have only been worn for trying on, as in a shop, and that the goods must be returned completely and undamaged. We also ask you to send the goods back to us in the original packaging. If these requirements are not met, the return of goods can be refused. The costs for the return will not be covered. The right of return does not apply to the purchase of gift vouchers if this is already stored in the user account, and not to contracts for the delivery of goods that are not suitable for return due to their nature. 7. RIGHT OF RETURN FOR PARTNER ITEMS

For all purchases of partner articles at www.sanfterjunge.com, Sanfter Junge and the respective partner grant you a voluntary right of return for a total of 14 days from receipt of the goods. You can then withdraw from the contract by returning the goods to the respective partner within 14 days of receipt of the goods (the period begins on the day after receipt of the goods). Timely dispatch is sufficient to meet the deadline. However, the prerequisite for exercising the right of return is that the goods have only been worn to try on, as in a shop, and that the goods must be returned completely and undamaged. We also ask you to return the goods in their original packaging along with any instructions. If these requirements are not met, the return of goods can be refused. The costs for the return will not be covered. The right of return does not apply to the purchase of gift vouchers if this is already stored in the user account, and not to contracts for the delivery of goods that are not suitable for return due to their nature. 8. REPAYMENTS

We will arrange for any prepayment repayments to the account you specified for the repayment. If you paid by credit or debit card, the refund will be made to the associated credit or debit card account. If you used a gift voucher for your purchase, we will credit the corresponding amount to your gift voucher account.

10. LEGAL LIABILITY AND ADDITIONAL INFORMATION

10.1 The statutory warranty for defects applies. Sanfter Junge expressly reserves the right to deliver a defect-free replacement to the buyer in the event of alleged and identified defects in the purchased item.

10.2 You can view these terms and conditions at www.sanfterjunge.com. You can also print out or save this document by using the usual function of your Internet service program (= browser: there usually "File" -> "Save as"). You can also download and archive this document in PDF format by clicking here. To open the PDF file, you need the free Adobe Reader program (at www.adobe.de) or comparable programs that can handle the PDF format.

10.4 Should individual provisions of the contract including these provisions be or become ineffective in whole or in part or should the contract contain an unforeseen gap, the validity of the remaining provisions or parts of such provisions shall remain unaffected. Instead of the ineffective or missing provisions, the respective statutory regulations apply.

11. DATA PROTECTION:

We use the data you provide to fulfill and process your order. Your data will not be passed on to third parties or used for advertising purposes. Once the contract has been fully processed and the purchase price has been paid in full, your data will be blocked for further use and deleted after the statutory retention periods have expired. We use technical and organizational measures to secure our website and other systems against loss, destruction, access, modification or distribution of your data by unauthorized persons. Despite regular controls, complete protection against all dangers is not possible. According to the Federal Data Protection Act (DSG), you have a right to free information about your stored data (Art. 8 DSG) and a right to correction (Art. 5 Para. 2 DSG). 12. APPLICABLE LAW AND JURISDICTION APPLICABLE LAW AND JURISDICTION

12.1 Swiss law applies to all legal transactions or other legal relationships with us. The UN Sales Convention (CISG) and any other international agreements do not apply. In the case of contracts for a purpose that cannot be attributed to the professional or commercial activity of the person entitled (contract with consumers), this choice of law only applies insofar as the protection granted by mandatory provisions of the law of the state in which the consumer has his habitual residence is not granted has been withdrawn.

12.2 With regard to consumers, the place of jurisdiction is the consumer's Swiss domicile. In business dealings with merchants, our place of business is agreed as the place of jurisdiction for all legal disputes about these terms and conditions and individual contracts concluded under their validity, including bills of exchange and check actions.
